1. Acceptance of Terms

Welcome to TucsonHIRED. By accessing or using our job board platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

TucsonHIRED reserves the right to modify these Terms at any time. We will notify users of any material changes via email or through our platform. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.

2. Description of Service

TucsonHIRED provides an online platform connecting employers with job seekers in the Tucson area. Our Service includes:

  • Job posting and management tools for employers
  • Job search and application features for job seekers
  • Profile management for both employers and job seekers
  • Application tracking and communication tools
  • Premium features available through paid subscriptions
  • Third-party job listings from partner networks

2.1 Third-Party Job Listings

In addition to jobs posted directly by employers on our platform, TucsonHIRED may display job listings from third-party sources, including job aggregation partners such as Talroo (Jobs2Careers) and other job distribution networks. These third-party listings are provided to enhance job seeker options and improve the breadth of opportunities available.

When you click on a third-party job listing, you may be redirected to an external website to complete your application. TucsonHIRED is not responsible for the content, accuracy, or legitimacy of third-party job postings, nor are we responsible for the application process, hiring decisions, or any interactions that occur on external websites.

2.2 Affiliate and Revenue Relationships

TucsonHIRED may earn revenue through partnerships with third-party job providers, including but not limited to cost-per-click, cost-per-application, or other performance-based compensation models. When you click on certain job listings or are redirected to third-party websites, we may receive compensation from our partners.

This affiliate relationship does not influence the relevance or quality of jobs displayed to you. Our search algorithms prioritize job relevance based on your search criteria and location, regardless of whether a job is posted directly on our platform or comes from a third-party source.

3. User Accounts

3.1 Registration

To use certain features of our Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify TucsonHIRED immediately of any unauthorized use of your account or any other breach of security.

3.3 Account Types

We offer two primary account types: Employer accounts and Job Seeker accounts. Users may only maintain one active account per email address and must select the appropriate account type based on their intended use of the Service.

4. User Conduct and Responsibilities

4.1 Prohibited Activities

You agree not to:

  • Post false, misleading, or fraudulent job listings or applications
  • Harass, abuse, or harm other users
  • Use the Service for any illegal purpose or in violation of any laws
  • Scrape, copy, or harvest data from the Service without authorization
  • Attempt to gain unauthorized access to our systems or other user accounts
  • Post content that infringes on intellectual property rights
  • Spam users or post unsolicited advertisements
  • Use automated systems or bots without our express written permission
  • Discriminate against any protected class in job postings or hiring practices

4.2 Employer Responsibilities

Employers agree to post only legitimate job opportunities and to comply with all applicable employment laws, including but not limited to equal opportunity employment laws and wage and hour laws. Employers are responsible for their own hiring decisions and interactions with job seekers.

4.3 Job Seeker Responsibilities

Job seekers agree to provide accurate information in their profiles and applications. Job seekers are responsible for their own employment decisions and due diligence regarding potential employers.

5. Content and Intellectual Property

5.1 User Content

You retain ownership of any content you post on TucsonHIRED ("User Content"). By posting User Content, you grant TucsonHIRED a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your User Content in connection with operating and promoting the Service.

5.2 Platform Content

All content on TucsonHIRED, excluding User Content, including but not limited to text, graphics, logos, software, and design elements, is the property of TucsonHIRED and is protected by copyright, trademark, and other intellectual property laws.

5.3 Content Removal

TucsonHIRED reserves the right to remove any User Content that violates these Terms or that we determine, in our sole discretion, is inappropriate or harmful to the Service or other users.

6. Payments and Refunds

6.1 Paid Services

Certain features of TucsonHIRED require payment. By purchasing these features, you agree to pay all applicable fees. All fees are non-refundable unless otherwise stated or required by law.

6.2 Job Credits

Employers may purchase job credits to post job listings. Job credits are non-transferable and non-refundable. Credits expire according to the terms specified at the time of purchase.

6.3 Pricing Changes

TucsonHIRED reserves the right to change pricing at any time. Price changes will not affect active subscriptions or purchased credits until renewal or future purchases.

7. Disclaimers and Limitations of Liability

7.1 Service Provided "As Is"

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

7.2 No Employment Guarantee

TucsonHIRED does not guarantee that employers will find suitable candidates or that job seekers will find employment. We are a platform that facilitates connections but do not participate in the hiring process or employment relationship.

7.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TUCSONHIRED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

7.4 Third-Party Content and Job Listings

TucsonHIRED is not responsible for the accuracy, reliability, or legality of User Content or third-party content. Users interact with other users at their own risk.

Specifically, TucsonHIRED makes no representations or warranties regarding third-party job listings provided through partners such as Talroo (Jobs2Careers) or other job aggregation services. We do not verify the legitimacy of third-party employers, validate job descriptions, or guarantee the accuracy of salary information, job requirements, or any other details in third-party listings. Job seekers are solely responsible for conducting their own due diligence before applying to any third-party job listing or providing personal information to external websites.

TucsonHIRED is not liable for any losses, damages, or negative experiences resulting from your interaction with third-party job listings or external websites, including but not limited to fraudulent postings, scams, misrepresentation, or any employment-related disputes.

8. Indemnification

You agree to indemnify, defend, and hold harmless TucsonHIRED, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of another party.

9. Termination

TucsonHIRED may terminate or suspend your account and access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service will immediately cease. Termination does not entitle you to a refund of any fees paid.

You may terminate your account at any time by contacting us or using the account deletion feature in your account settings.

10. Dispute Resolution

10.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions.

10.2 Dispute Resolution Process

In the event of any dispute arising from these Terms or your use of the Service, you agree to first contact TucsonHIRED to attempt to resolve the dispute informally. If the dispute cannot be resolved informally, you agree that any legal action must be brought in the state or federal courts located in Pima County, Arizona.

11. General Provisions

11.1 Entire Agreement

These Terms constitute the entire agreement between you and TucsonHIRED regarding the use of the Service and supersede all prior agreements.

11.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

11.3 Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term.

11.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. TucsonHIRED may assign these Terms without restriction.
